PACKAGE 1: CANCELLATION INSURANCE (to be subscribed on the day of booking).


GENERAL TERMS AND CONDITIONS:
People covered: All people having booked a stay with Goélia and who make a request by the latest on the date of booking.
o Pursuant to article 1964 of the Civil Code, the insurance policy is a random policy, namely an agreement whose effects, in terms of benefits or losses, for the parties, depend on a clear event.
o The present agreement is governed by French law and the Insurance Code. This comprises the General and Special Terms and Conditions and includes rights and obligations for you and us.
o The cover is applicable to all travel lasting for a maximum of 2 consecutive months sold by a travel professional.
o Pursuant to the provisions set forth under article 27 of law no. 78-17 of 6th January 1978, you have a right to access and amend personal information.

Please read carefully the general terms and conditions which follow: These outline your rights and obligations by answering the questions which you may have.

Definitions for application of cover outlined hereunder:

o ACCIDENT refers to any sudden, unplanned event outside the control of the victim or the item damaged, constituting the cause of corporal or material damage.
o SERIOUS ACCIDENT is any temporary or definitive damage to your physical integrity, medically observed, implying the end of any professional activity or other and needing medical care or supervision.
o FIRST AID REQUIREMENTS refer to clothing and toiletries allowing you to temporarily face up to non-availability of your personal effects.
o CONFIRMATION OF THEFT is a formality required by the travel organiser in line with terms and conditions set forth under the conditions of sale, so as to approve the purchase of a ticket and maintain a booking.
o CONSOLIDATION is an observation made by a medical authority indicating, at any time, that the medical condition of the person is unchanged.
o CORPORAL DAMAGE means any accidental corporal harm suffered by a natural person.
o MATERIAL DAMAGE refers to any damage or accidental damage to any item or substance, or any physical harm to animals.
o CONSEQUENTIAL IMMATERIAL DAMAGES refers to any financial prejudice resulting from the deprivation of use of any right, interruption to any service rendered by a person or by an item of furniture or property or the loss of profit and leading directly to occurrence of corporal or material damages.
o EUROPE European Union and Switzerland
o SEARCH AND RESCUE COSTS refers to the cost of operations undertaken by emergency services, other than travel companions and travelling especially so as to search and rescue you from any place where there are no close or organised rescue means.
o ASSISTANCE COSTS refers to transportation costs after an accident (whilst you have been located) from the place where the accident occurs to the closest hospital.
o ACCOMMODATION FEES refers to additional hotel and telephone costs with Mondial Assistance following any covered event, excluding all costs for sustenance and beverages.
o FUNERAL COSTS refers to costs for initial conservation, handling, placing into a cask, specific arrangements for transportation, care of conservation made compulsory by legislation, packaging and the simplest coffin, required for transportation and complying with local legislation, excluding burial, embalming and ceremony costs.
o MEDICAL COSTS include pharmaceutical, surgical, consultation and hospitalisation costs medically prescribed and necessary for diagnosis and treatment of a pathology justifying our intervention.
o HOSPITALISATION is an emergency intervention lasting over 24 hours in hospital and unscheduled and not listed.
o SERIOUS ILLNESS is any alteration to your health condition observed by a medical authority, implying the end of any professional activities or otherwise and having required medical care and supervision.
o US refers to Mondial Assistance International
o FLIGHT DELAY refers to any delay between the departure time announced to the passenger on the ticket or travel registration document and the actual time when the flight leaves the stand, outside of any possible modifications to times scheduled by the organised in the General Terms and Conditions of Sale.
o INCIDENT refers to any event of which performance meets the terms and conditions in the agreement and is likely to lead to application of one of the items of cover subscribed. All damage coming from the same initial cause constitutes a single and unique incident.
o THIRD PARTY refers to any natural person or legal entity excluding: The policyholder, members of family, people accompanying him/her, staff, employees or not, in their post.
o TRIP is the itinerary covered up to the destination indicated on the ticket or travel registration document, regardless of the number of flights taken, whether the outward or return trip.
o PUBLIC AIR TRANSPORTATION is the air transportation service which is available to the general public against payment and directly distributed by approved agents or the travel organiser having chartered the flight, of which the time, availability and price is distributed publicly and leads to a travel document.
o REGULAR FLIGHT refers to a scheduled flight undertaken by a commercial flight of which the precise times comply with those in the “Official Airlines Guide”.
o “CHARTER" FLIGHT is a flight chartered by a tourism organisation as part of a non-regular service.
o YOU refers to the policyholder
o TRAVEL refers to the travel or trip scheduled and organised by the subscriber during the term of validity of the present agreement.

Cover and Ceiling of Cover:
Cancellation costs 30 to 15 days from departure = 50% of the price of the trip
Cancellation costs 14 to 8 days from departure = 75% of the price of the trip
Cancellation costs less than 8 days from departure = 100% of the price of the trip
Maximum ceiling of cover per person = €6097,96 and per event= €30,489.80
Absolute excess: depending on the cause of cancellation

CANCELLATION (Appendix A1)

1.-OUR COVER

11.-Object of cover: When you cancel your trip, the organiser will charge you in whole or in part for the services cancelled, called cancellation costs. These costs are higher the closer to the date of departure and are calculated in line with the general terms and conditions of sale in the brochure. Our cover consists of completing reimbursement of the traveller, airline or rental firm by reimbursing you the total of cancellation fees which you contractually incur when you cancel a trip, before the departure, for any reason of cover. In terms of rental, our cover is granted under the condition that the rental has been completely released. ATTENTION: All tourist services covered by this policy whether complementary or successive, constitute a single trip, for which only one departure date is used: that indicated by the travel organiser as marking the start of the covered services.
12.Events leading to the entitlement to cover: We intervene when you are under the obligation to cancel your trip for any of the following reasons:
12.1. a serious illness, serious corporal accident including the follow up, consequences, complications or deterioration of an illness or accident observed prior to booking your trip or death of: a) you, your partner or spouse, ascendants or descendants b) your brothers, sisters, step brothers, step sisters, brother in law, sister in law, father or mother in law. It is incumbent upon you to establish the reality of the situation leading to entitlement to our services, consequently we hereby reserve the right to refuse your request, upon advice by our doctors, if the information provided does not prove the reality of the facts.
12.2.Serious material damages following robbery, fire, water damage or a weather event, making it essential for you to be in situ on the date scheduled for departure, for implementation of conservatory measures and administrative formalities and affecting over 50% of your main or secondary residence.
12.3.Economic dismissal under the condition that the proceedings have not been incurred as at the date of subscribing this policy.
12.4.Awarding any employment or paid placement effective prior to or during the scheduled dates of your travel, whilst you were registered as unemployed, under the condition that this does not concern any extension or renewal of the contract, nor any assignment provided by any temporary employment agency.
12.5.Serious damage to your vehicle occurring within 48 hours preceding your departure insofar as this cannot be used to travel to your destination.
12.6.Your imperative and non-deferrable summons to a court as witness or juror.
12.7.Your summons to a date located during the term of your insured travel, to a university examination subject that failure in the examination was unknown at the time of subscribing the present policy.
12.8.Your summons for adoption of a child during the term of your insured travel, subject that this was unknown at the time of subscribing the present policy.
12.9.Cancellation for any reason covered by one or more people registered at the same time as you and insured under the present policy, if this withdrawal means that you travel alone.
12.10 Lack of or excess snowfall, when occurring in resorts located at over 1,500 metres of altitude, between 15th December and 15th April, and leading to closure of over two thirds of mechanical ski lifts normally in service on site during your stay, during or less than two consecutive days, within five days preceding your departure. .

2.-TOTAL COVER

21.Compensation paid pursuant to the present agreement may under no circumstances exceed the total amount of fees invoiced by the organiser, pursuant to contractual schedules and up to a limit of the ceiling indicated under the Special Terms and Conditions.
22.We will compensate you for the total amount of cancellation fees invoiced by the organiser pursuant to the schedule indicated under its General Terms and Conditions of Sale; However, we limit our cover to the total fees which you would have been invoiced pursuant to this schedule if you had notified the organiser within 48 hours of occurrence of the event leading to the entitlement to cover. Administration fees, tips, visa costs and the bonus paid in return for subscription of the present agreement are not able to be reimbursed.
23.Excess per policyholder (or per file for locations and sea cruises) fixed in the Special Terms and Conditions is always deducted from the compensation payable.

3.-TERMS AND CONDITIONS OF APPLICATION OF COVER

31.Cover should be taken out and registered with Mondial Assistance International on the day of booking the stay to be covered.
32.Cover is applicable from the 1st day of application of the schedule of cancellation fees or as at the date of subscription of the present policy if this takes place subsequently and ends on the time when the first of the covered services starts.
33.Application of cover for insurance cannot be accumulated with that for other cover taken out in the present policy.

4.-EXCLUSIONS FOR COVER

In addition to exclusions common to all cover (chapter 3 of the common availability), the following are also excluded:
41.Illness or accidents leading to an initial observation, treatment, relapse, damage or hospitalisation between the date of reservation of your travel and the date of subscription of the present policy.
42.Pregnancy, notwithstanding any clear and unlikely complication, abortion, birth, in-vitro fertilisation and the consequences thereof.
43.Forgetting to be vaccinated.
44. Any medical event of which the diagnosis, symptoms or cause is psychic, psychological, psychiatric and which did not lead to hospitalisation in excess of 5 consecutive days after subscription of the present policy.
45. Accidents resulting from amateur or any other level of practising mechanical sports (auto, moto, all motor vehicles), or aerial sports. 46. Epidemics, pollution, natural disasters which are outlined in the procedure for which provision is made by law 82.600 of 13th July 1982 and their consequences.
47.The consequences of criminal proceedings in which you are involved.

5.-WHAT YOU SHOULD DO IN THE EVENT OF MAKING A CLAIM

51.You should notify the organiser of your trip of your withdrawal as soon as possible (fax, telegram, email, declaration to the agency) as soon as any covered event preventing your departure occurs or by the latest within 48 hours. Please note: If you inform your organiser late of your intention to cancel, we can only pay for cancellation costs contractually payable as at the date of occurrence of the event leading to the entitlement to cover and you remain liable for the difference.
52. You should notify us of the incident within 5 working days once you are aware thereof, notwithstanding any fortuitous instance or case of force majeure:
o either by telephone on 01 42 99 03 95 from Monday to Friday from 9am to 6pm

You will have all necessary information to make your declaration. You will receive, in due course, a file to be constituted which you should return completed to Mondial Assistance International along with any document requested to justify the reason for cancellation and to evaluate the total prejudice (travel registration form, invoice for cancellation fees, travel documents). Moreover, if the reason or your withdrawal is illness or a corporal accident, you should send the doctor from Mondial Assistance International all information or documents required for consideration of the well-founded nature of your request.

ADMINISTRATIVE PROVISIONS

1.-POLICYHOLDERS are covered by virtue of the present policy as indicated in the Special Terms and Conditions, under the condition of having their legal or fiscal residence in the European Union and Switzerland.

2.-OBJECT OF THE POLICY The cover granted is that defined hereinabove for those risks for which insurance is planned in the package included in the Special Terms and Conditions and for which the subscriber has received the corresponding premium.

3.-EXCLUSIONS COMMON TO ALL RISKS In addition to particular exclusions to each item of cover, the following consequences and events are also excluded from all cover:
3.1.Civil war or a foreign war, riots, popular uprising, strikes, acts of terrorism, hostage taking, arms handling.
3.2.Your voluntary participation in betting, crimes or riots, aside for in self-defence.
3.3.Any action with a nuclear origin or caused by any source of ionising radiation.
3.4.Intentional actions, wilful misconduct, including suicide and attempted suicide.
3.5.Consumption of alcohol, drugs and any substance indicated in the Public Health Code not medically prescribed. 3.6.Knowing default in observations of official breaches, as well as default in recognised safety rules, related to the practice of any sporting activity.
3.7.Your participation in any sport undertaken professional or under a paid contract.
3.8.Incidents occurring outside of counties covered as indicated in the Special Terms and Conditions or outside of the period of validity of the present policy.
3.9.Incidents occurring during the performance of services which were not organised by the subscriber.
3.10.Events occurring between the date of booking of your trip and the date of subscription of the present policy as well as their consequences.

4.-GEOGRAPHICAL SCOPE OF THE POLICY
Cover is applicable in the country or countries visited during the trip organised by the subscriber and indicated on the travel registration document.

5.-ACCUMULATED INSURANCE
You should declare, pursuant to article L 121-4 of the Insurance Code any other insurance policy taken out for the same risk. In the event of any incident, you can send your claim to an insurer of your choice.

6.-SUBROGATION IN YOUR RIGHTS AND ACTIONS

In return for payment of the compensation and up to the total amount thereof, we become beneficiaries of the rights and actions which you have against the person responsible for any claim, pursuant to article L 121-12 of the Insurance Code. If we are no longer able to take this action, due to you, we can be released in whole or in part from our obligations towards you.

7.-YOUR DECLARATIONS UPON SUBSCRIPTION OF THE POLICY

Any hesitation or incorrect declaration, omission or inaccuracy in the declaration of risk is sanctioned in line with the terms and conditions for which provision is made under articles L 113-8 and L 113-9 of the Insurance Code.
o In the event of bad faith by you: By contractual invalidity
o In the lack of established bad faith: By any reduction of the compensation in proportion to the premium paid which would have been due if the risk had been completely and accurately declared.

8.-YOUR DECLARATIONS AT THE TIME OF THE INCIDENT

Any fraud, hesitation or incorrect and intentional declaration by you which misleads us as to the circumstances or consequences of an incident leads to the loss of any right to a service or compensation for this incident.

9.-STATUTE OF LIMITATIONS
o Any action deriving from the present policy has a statute of limitations of two years from the triggering event, in line with terms and conditions set forth by articles L 114-1 and L 114-2 of the Insurance Code.
o This statute of limitations will notably be interrupted by the issue of a recorded delivery letter with acknowledgement of receipt which you should send to our registered office concerning payment of the compensation or by appointment of experts following an incident.

10.-EVALUATION OF DAMAGES

o The causes and consequences of the incident are estimated on a case by case basis, failing amicable expertise, subject to the respective rights of the parties.
o Each party appoints an expert. If the experts appointed disagree, they will then appoint a third expert: The three experts will work jointly and by the majority of votes; In such instance as one of the parties fails to appoint its expert or the two experts fail to agree on the choice of the third, the appointment will be undertaken by the District Court in the place of residence of the subscriber. This appointment is undertaken upon simple request signed by both parties or only one, the other having been convened by recorded delivery letter.
o Each party pays the costs and fees of its expert and, where applicable, half of the fees of the third party expert.

11.-DEADLINE FOR PAYING CLAIMS
Insofar as your file is complete, your compensation is paid within 10 days following the agreement made between us and the enforceable legal decision.

12.-TERMS AND CONDITIONS FOR CONSIDERING CLAIMS

PACKAGE 2: CANCELLATION + MULTI-RISK INSURANCE (must be taken out the date of booking) only if the sport or leisure activity concerned has been paid to GOELIA (on the invoice)
1/ REPATRIATION ASSISTANCE WITH MEDICAL FEES
Repatriation Assistance:
➢ Organisation and return of the policyholder to the place of residence or transportation to a hotel (Totals and limits of cover: Actual costs)
➢ Organisation and payment for the return of the covered accompanying people (Totals and limits of cover: Actual costs).
No excess for these two items of cover.
➢ Assistance for children of the Policyholder: Organisation and return of children of the policyholder where the latter is repatriated (Totals and limits of cover: Actual costs).
➢ Provision of a driver for return of the car of the policyholder (Totals and limits of cover: Wage and travel costs of the driver). ➢ Assistance in the event of death of a policyholder: o Transportation of corpse (Totals and limits of cover: Actual costs).

o Funeral costs (Totals and limits of cover: Up to a limit of €2,300 per policyholder).
o Additional transportation fees for family members of the policyholders accompanying the policyholder (Totals and limits of cover: Actual fees).
o Payment of fees allowing a family member to meet the corpse of the policyholder (return trip (Totals and limits of cover: Actual costs), Accommodation costs in situ until repatriation – (Totals and limits of cover: Up to a limit of €50 per day and per person, for a maximum of ten days)
o Legal assistance: Reimbursement of legal fees (Totals and limits of cover: €3,000 per person insured and per incident), advance on criminal security (Totals and limits of cover: €15,000 per person insured and per incident).

2/ SUSPENSION OF SPORT OR LEISURE ACTIVITY
➢ Impossibility to access the resort (Totals and limits of cover: Reimbursement of a day on a pro rata basis of the total amount of services, passes for mechanical ski lifts and equipment hire).
➢ Closure of mechanical ski lifts (Totals and limits of cover: Reimbursement of your pass for mechanical ski lifts unused as well as equipment hire).
➢ In the event of a ski accident:
o Totals and limits of cover: Reimbursement of your pass for mechanical ski lifts unused up to a limit of €300 per person covered and per incident.
o Totals and limits of cove: Reimbursement of the hire of your unused equipment up to a limit of €200 per person covered and per incident. No excess.

3/ ACCIDENTAL BREAKAGE OF SPORTS EQUIPMENT
Compensation for rental of sports equipment (Totals and limits of cover: €200 per person insured and per incident). No excess.

PACKAGE 3: MULTI-RISK SNOW

1/ REPATRIATION ASSISTANCE WITH MEDICAL COSTS
Repatriation Assistance:

o Legal assistance: Reimbursement of legal fees (Totals and limits of cover: €3,000 per policyholder and per incident), advance over criminal security (Totals and limits of cover: €15,000 per policyholder and per incident).
